Terms & Conditions of Purchase

In plain words

This summary is a guide. The numbered sections below are the agreement, and they govern if anything here is read differently.

  • Everything we make is custom. Once production starts, an order cannot be cancelled, changed, returned or resold.
  • Your artwork is your responsibility. Spelling, phone numbers, sizes, layout, resolution and colour mode. We print what you send.
  • Printed colour will not match your screen. The Colour-critical service (RM50 per item, with a physical sample) is the only route to a visual match.
  • Sizes and finishing have tolerances. Anything within the tolerances in Section 9 is not a defect.
  • Production time starts when your payment has cleared and your artwork has passed our checks. Dates are estimates, never guarantees.
  • Report problems quickly: transit damage within 48 hours, any other defect within 7 days, with photos.
  • Installation (KL & Selangor) needs your signage permit, your landlord's consent and a sound wall or fascia. Those are yours to arrange.
  • Ticking the box at checkout accepts these Terms for that order. We record the version you accepted.

1. Who we are and what these Terms cover

"Tandaku" and "tandaku.com" are trading names of UMAKE Design Group PLT, a limited liability partnership registered in Malaysia under number 202404001456, with its place of business at 13-2, Jalan Minlon Utama, Accession Industrial Park, 43300 Seri Kembangan, Selangor, Malaysia ("we", "us", "our"). These Terms & Conditions of Purchase ("Terms") apply to every order for goods or services you place with us, whether through the website, WhatsApp, email, in person at our shop, or by accepting a quotation we issue, and whether you buy as a consumer or as a business. They cover our full range: printed signage and boards, banners and buntings, stickers and decals, acrylic and laser-cut products, cut-out and box-up letters, fabricated signboards and lightboxes, display stands, safety and regulatory signs, raw material sheets, personalised photo products, design work and installation.

These Terms are read together with our Privacy Policy, Cookie Policy, Shipping Policy and Return & Refund Policy. If any of those pages, a product page, a FAQ answer or a message from us conflicts with these Terms on anything to do with an order, these Terms prevail.

Part of the production may be carried out by our related manufacturing company or by trusted production partners under our supervision. We remain the party you contract with and the party responsible to you.

2. Definitions

  • Custom Product means any item that is printed, cut, fabricated, assembled or personalised to your specification. This includes cut-to-size raw material sheets, safety and regulatory signs printed on demand from our designs, personalised photo products and any design work. In practice it means everything we sell.
  • Artwork means any file, image, text, photograph, layout, colour reference, sample or instruction you supply for an order, including text you type into a template on the website.
  • Production starts the moment your order is released to be printed, cut, fabricated or otherwise made. On the website this is shown as the order moving to "In production" or "Printing".
  • Working Day means Monday to Saturday 09:00 to 18:00, Malaysian time, excluding Sundays and public holidays observed in Selangor and the Federal Territory of Kuala Lumpur, and any closure we announce on the website or our social media.
  • Quotation means a written quotation document issued by us through the website or our accounting system. A price mentioned in a chat, call or email is not a Quotation.
  • You means the person or company placing the order. If you order for a company, organisation or another person, you confirm that you are authorised to bind them, and "you" includes them.

3. How you accept these Terms

  • Website orders: you accept these Terms by ticking the acceptance box at checkout. We record the version you accepted and the time against your order.
  • Quotations, WhatsApp, email and walk-in orders: you accept these Terms by paying, by asking us to proceed, or by handing us Artwork for an order. The version in force at tandaku.com/terms at that time applies.
  • You must be at least 18 years old to order. If you are younger, a parent or guardian must place the order and accepts these Terms on your behalf.
  • Each order is governed by the version of these Terms in force when the order was placed. Later changes do not apply to an order already placed.

4. Everything we sell is made to order

We do not hold stock of finished goods. Every item is produced for you, to your size, material, finishing and Artwork, after you order. Because of this:

  • A Custom Product cannot be returned or exchanged because you changed your mind, ordered the wrong size, material or quantity, or no longer need it.
  • Raw material sheets are supplied against your order, whether full sheets or cut to size, and are not returnable except where defective.
  • Personalised photo products start Production when you approve the digital preview. Approval confirms the design, crop and text.
  • Your statutory rights in relation to goods that are defective or not as described are not affected by this section. See Section 15.

5. Prices, quotations and what is included

  • All prices are in Malaysian Ringgit (MYR). The price of a website order is the price shown at the moment you place it, calculated automatically from the material, size, quantity and finishing you choose. We follow the dimensions you enter. If your Artwork does not match those dimensions, Section 7 applies.
  • Shown separately at checkout and payable in addition to the item price: delivery; a packing and protection charge of RM3 per order plus RM6 per square metre of the largest item for courier and Lalamove orders (not for self-collection, and not waived by free delivery); the Colour-critical service at RM50 per order line; installation and wiring options; die-cut setup; and any other option you select.
  • We are not currently registered for Sales and Service Tax and prices do not include SST. If SST or any other tax or levy becomes chargeable on your order, it will be shown before you pay.
  • Quotations are valid for 7 days from issue unless they say otherwise. The price and any material reservation lapse when the Quotation expires, and a fresh Quotation may differ.
  • Prices mentioned in chat are indicative only until confirmed by a website order or a Quotation. Some of our replies on WhatsApp and email are drafted with automated tools and checked by our team. A message that quotes a price, discount, lead time or delivery date does not bind us unless it is a Quotation, an order confirmation, or a written confirmation from our staff that refers to your order number.
  • Obvious errors: if a price is clearly wrong because of a system, catalogue or typing error, we may cancel the order before Production and refund you in full, or offer you the correct price. You are free to decline the corrected price.
  • We may change our prices at any time. Paid orders are not affected. Unpaid orders and expired Quotations may be repriced.

6. Placing an order, payment and confirmation

  • Your order is an offer to buy. We accept it when we send the order confirmation after your payment has cleared. Until then no contract exists, even if you have received an automatic acknowledgement.
  • We may decline or cancel an order for reasons including suspected fraud, prohibited content (Section 17), unavailable material, a delivery address we cannot serve, an unpaid earlier order, production capacity, or conduct described in Section 26. If we decline an order you have already paid for, we refund you in full.
  • Payment methods: online payment through our payment gateway, HitPay, by online banking (FPX), DuitNow QR, credit or debit card, or e-wallet. Bank transfer is accepted only when we have agreed to it in writing, and Production does not start until cleared funds are in our account. We do not offer cash on delivery, and we do not start Production on a deposit unless a written deposit arrangement says so.
  • Unpaid orders expire automatically 7 days after they are placed. The payment link and any Quotation expire with them. Nothing is charged for an expired order.
  • Company buyers who need a document before paying can request a Quotation at checkout. The tax invoice, receipt and LHDN e-Invoice are issued automatically after payment.
  • e-Invoice (LHDN MyInvois): if you want an individual e-Invoice, give us your correct Tax Identification Number (TIN), business registration or identity number, SST number (if any), address and email at checkout or before you pay. We submit the e-Invoice after payment. If you do not supply these details, your purchase is reported under a consolidated e-Invoice and an individual e-Invoice may not be available later. Corrections after LHDN validation are limited to the window LHDN allows, currently 72 hours. We are not responsible for errors in details you supply.
  • Changes after payment are possible only before Production, at our discretion. Any price difference is payable before we proceed, and a change may restart the production clock.

7. Your artwork

You are responsible for the content and print-readiness of every file you supply.

That includes spelling, grammar, translation, phone numbers, prices, dates, logos, layout, size, orientation, bleed, resolution, colour mode, fonts and image quality. We reproduce your file as supplied. A mistake in the file is reproduced in the print and is not a defect.

7.1 File requirements

  • Preferred: vector PDF, AI or SVG with fonts outlined or embedded and images embedded. Accepted: PNG, JPG and TIFF.
  • Raster images must be at least 150 dpi at the final printed size, and at least 300 dpi for items normally viewed from within one metre (stickers, labels, acrylic and desk signs, photo products). Files taken from websites or social media are usually too small and will print soft.
  • Set up at actual size, or at an exact scale you tell us, in CMYK colour mode, with 3 mm bleed on every printed edge and important text and logos at least 5 mm inside the cut edge.
  • Die-cut and kiss-cut jobs need the cut line on its own layer or as a named spot colour. White ink, spot varnish and metallic layers must be on separate, named layers.
  • Files up to 30 MB upload directly on the website. Larger files may be sent by cloud link.

7.2 What our checks do, and do not do

Every file goes through an automated preflight and a visual check by our team for size, resolution, bleed and colour mode, and we flag obvious technical problems before Production. This check is a courtesy and is not proofreading, design, translation or legal review. We do not check spelling, wording, numbers, prices, dates, logos, brand colours, regulatory wording, or whether you have the right to use the content, and we do not verify that the design will suit your purpose.

7.3 If we find a problem

  • We contact you by WhatsApp or email. The production clock pauses until we have a usable file, and any delivery estimate moves accordingly.
  • If you tell us to proceed with the file as supplied, we print it as supplied and the result is your responsibility.
  • If we cannot reach you or do not receive a usable file within 7 Working Days, we may cancel the order and refund you less the deductions in Section 11.

7.4 Technical preparation is not design

We may add bleed, convert colour mode, impose, nest, scale to the ordered size or make other technical adjustments needed to print your file. This does not make us the author of your Artwork and does not shift responsibility for its content to us.

7.5 Templates and ready designs

Safety signs, regulatory signs, templates and other ready designs are supplied in standard wording, languages and pictograms. You are responsible for checking that the wording, language, size and pictogram are correct and suitable for your use. Text you type into a template is printed exactly as typed. See also Section 16.

7.6 Design work by us

  • We provide design or layout work only when it is quoted separately. Unless the Quotation says otherwise, it includes two rounds of revision; further rounds are chargeable.
  • You approve a digital proof before Production. Approval confirms the content, spelling, layout and size, and responsibility for them passes to you.
  • Design work remains our property until paid in full. After payment you receive a licence to use the design for the product ordered. Editable source files are not included unless the Quotation says so.

7.7 Keeping your files

Files uploaded but not attached to a paid order are deleted after 30 days. Files on a paid order are kept for as long as reasonably needed for reprints, warranty claims and record-keeping, then deleted in line with our Privacy Policy. Keep your own copy of every file you send us.

8. Colour

  • Screens are not print. Phones and monitors show colour as backlit RGB light; we print with CMYK inks on a material. Every screen is calibrated differently. The printed colour will differ from what you saw on screen, and that difference is not a defect.
  • Batches, machines and materials differ. The same file prints differently on UV, eco-solvent, latex and sublimation machines, on different materials, and in different print runs. A reorder may not match the original, and a banner, an acrylic sign and a sticker printed from one file will not match each other exactly.
  • We do not guarantee a match to Pantone, RAL or any other spot colour reference. Spot colours are simulated in CMYK.
  • Metallic, fluorescent, gold, silver and white ink, mirror and clear materials, and backlit faces change appearance with the substrate, lighting and viewing angle, and are never exact.
  • Colour-critical service. If colour matters, choose the Colour-critical option (RM50 per order line), upload a photo of your physical sample and hand or post the sample to us. Our technician contacts you before printing and matches visually to your sample under our shop lighting, to a commercially reasonable tolerance. This is the only route to a matched colour. Even with this service a small difference may remain, and that is not a defect.
  • Without the Colour-critical service, colour is printed as our machines interpret your file, and no colour claim is accepted.

9. Size, print and finishing tolerances

Printing, cutting and finishing are physical processes and much of the finishing is done by hand. The tolerances below are standard for the trade. A product within these tolerances conforms to the order and is not defective.

Also accepted as normal, and not defects:

  • Fine print lines, slight banding, small ink marks or specks, and minor colour drift, particularly in large flat areas, light tints and gradients on large-format outdoor products that are made to be viewed from a distance.
  • Minor irregularities in hand finishing: hemming, sewing, welding, joining, gluing, edge polishing, eyelet placement and cutting.
  • Welded or sewn joins on any print wider than the roll it is printed on. Banners, backdrops and billboards above about 1.5 m on the short side are joined from more than one panel.
  • A small blank margin or trim variance at the edge of any print.

If your project needs a closer tolerance than the table above, tell us in writing before you pay. We will say whether it can be met and at what price, and if it cannot, we recommend you do not order.

10. Material behaviour and what is not a defect

You choose the material. Each material behaves in its own way, and the behaviour below is inherent to the material, not a fault in the product.

  • Acrylic: supplied with protective film that you peel off. Fine handling marks, tiny bubbles or inclusions in cast sheet, slight edge marks from laser cutting and variation in flame-polished edges are normal. Acrylic scratches and can crack or craze when exposed to solvents, alcohol-based cleaners, adhesives or over-tightened fixings.
  • Foamboard, KT board and PVC foam: dent under pressure and bow in heat, humidity or direct sun. They are indoor or short-term outdoor materials.
  • ACP, aluminium and steel: panel bow within tolerance, edge burr, and minor marks beneath the protective film are normal. Steel may show weld marks and grinding at joins.
  • Banners, tarpaulin and vinyl: creases from rolling or folding relax over time. Wind, rain and sun wear them. Eyelets and hems are set by hand.
  • Fabric: wrinkles from packing that steam or hang out, visible seams, and shrinkage within tolerance.
  • Stickers and decals: adhesion depends on the surface. We are not responsible for lifting, bubbling or peeling on textured, dusty, oily, damp, freshly painted, low-energy plastic or silicone-treated surfaces, or when applied in the wrong temperature. Removal may leave residue or lift weak paint. You apply them at your own risk unless we are contracted to apply them.
  • Lightboxes and LED products: illumination is even within reason; slight hot spots near edges and modules are normal. LED and power supply life depends on hours of use, ventilation and the quality of your electricity supply. Surge, water ingress, insect ingress and tampering are not covered.
  • Wood, plywood and MDF: grain, knots and colour vary naturally, and the material moves with humidity.
  • Magnets: hold depends on the steel surface. Vehicle magnets need a flat, clean, painted steel surface and regular removal and cleaning.
  • Outdoor life: any durability figure we give is indicative. Fading, chalking, weathering and wind damage are wear, not defects, and depend on location, orientation and climate.

11. Changing or cancelling an order

Before Production starts

You may cancel by WhatsApp or email quoting your order number. We refund you to your original payment method. We may deduct: an administrative fee of RM10 where our team has already checked or prepared your Artwork or issued a Quotation or invoice; any payment-gateway charge that the gateway does not return to us; the cost of material already cut, purchased or reserved specifically for your order; and any design work already done at the quoted rate.

Once Production has started

The order cannot be cancelled, changed, reduced or refunded. This includes artwork corrections, changes of size, material, finishing or quantity, and a change of delivery method. Additional items are a new order. The item has been cut to your size and printed with your Artwork and has no other buyer.

  • Unpaid orders expire automatically after 7 days with nothing to pay.
  • Cancellation by us: if a material is unavailable, we offer an alternative or refund you in full. If we decline an order for prohibited content or because we cannot serve the address, we refund you in full. Where an order is cancelled for suspected fraud, we may refund less any payment-gateway charge not returned to us. Section 22 covers events beyond our control.
  • How refunds are paid: to the original payment method through HitPay, within the timelines in our Return & Refund Policy. We do not refund in cash, to a different account, or to a different person. Any part of an order paid with a gift card is refunded to that gift card.

12. Production time and deadlines

  • Production times shown on product pages, at checkout, in Quotations or in messages are estimates, not promises.
  • The production clock starts on the next Working Day after the last of these has happened: your payment has cleared; your Artwork has passed our checks; you have approved any proof or preview; and, for a Colour-critical order, we have received your physical sample.
  • Sundays, public holidays and announced closures are not counted. Orders received after 18:00 on a Saturday count from Monday.
  • Large orders, multi-item orders, fabricated products (signboards, lightboxes, box-up letters, stands), installation jobs and special-order materials take longer and are estimated individually.
  • Deadlines: if you need the order for an event, opening, launch, inspection or campaign, tell us in writing before you pay. We will say whether we expect to meet it. Even then the date is not guaranteed, and we are not liable for any loss, cost or disappointment if a deadline is missed. Order early, and where a date is critical consider self-collection or a courier upgrade.
  • Rush production, where we offer it, is subject to capacity, may carry a surcharge, and remains an estimate.

13. Delivery, collection and risk

  • We deliver within Malaysia only, by parcel courier, by Lalamove or similar on-demand delivery within the Klang Valley, or by self-collection at our Seri Kembangan shop during Working Days after we message you that the order is ready. We choose the courier for each parcel.
  • Oversized and fragile items: rigid boards with any printed side over 1,200 mm, fabricated signboards and lightboxes, large acrylic pieces and stands cannot travel by parcel courier and are self-collection or Lalamove only. Free-delivery thresholds and promotions do not apply to Lalamove or oversized items.
  • Your address: you are responsible for a complete, correct delivery address and a reachable phone number. A change of address after dispatch may be impossible or chargeable. If delivery fails because the address is wrong or incomplete, nobody is available, the parcel is refused, or the courier cannot reach you, the parcel is returned to us and redelivery is charged at the courier's rate. Any parcel or self-collection order not collected within 30 days of our notice may be disposed of without refund.
  • Proof of delivery: the courier's record of delivery, whether a signature, a photo, an OTP or receipt by a guard, receptionist, family member or colleague at the address, is proof that we delivered. We are not responsible for a parcel that goes missing after that point.
  • Risk in the goods passes to you when they are delivered to your address, handed to your Lalamove driver or authorised collector, or collected by you. Ownership passes when we have been paid in full.
  • Delivery times are estimates. We are not responsible for courier delays. If a parcel is lost, tell us within 7 days of the expected delivery date. We claim against the courier and reprint or refund once the courier confirms the loss, usually within 7 to 14 days.
  • Damage in transit: photograph the outer packaging and the item, and send the photos to us with your order number, within 48 hours of delivery. Keep the packaging; the courier's claim needs it. Damage reported later, or without photos, cannot be claimed from the courier and is not accepted.
  • Lalamove and self-collection: check the item when it is handed over and report any damage before the driver leaves or before you leave the shop. We do not release an order to a third party without your instruction.

14. Installation services

Where you order installation (available in Kuala Lumpur and Selangor only), the following applies.

14.1 What is included

One visit, on a date we agree with you, to fit the ordered item with standard fixings to an existing, structurally sound wall, fascia, frame or fixture at the floor level you selected. Installation above the fifth floor is quoted after a site survey. Not included unless quoted: removal and disposal of old signs, making good, painting, patching, scaffolding or lifting equipment beyond what your selection covers, permits, and electrical work beyond the wiring option described on the product page.

14.2 What you must arrange

  • Any signage licence or permit required by the local authority, and any consent required from your landlord, building management or joint management body. We do not apply for permits and we do not check whether you have one. Fines, removal orders and rework arising from a missing permit are your responsibility.
  • Confirmation of the exact position and height before we drill. A change of position after drilling is a chargeable repeat visit.
  • A suitable power point at the sign position for lit products, or the wiring option. We connect to your existing supply; faults in that supply and any works needing a licensed electrical contractor are yours to arrange.
  • Safe access, parking, a clear working area, and information about anything concealed in the wall or fascia, such as pipes, cables and ducts.
  • Your presence, or an authorised representative, to confirm the position and sign off the completed work.

14.3 Site conditions and repeat visits

If the surface is unsafe or unsuitable, access is blocked, the permit is missing, the weather makes work unsafe, or the site is not ready when we arrive, we may stop or reschedule. A wasted or repeat visit is charged at our call-out rate, which we tell you before rebooking. We are not liable for damage to concealed pipes, cables or services that you did not disclose or that could not reasonably be detected, and you accept that drilling into tile, glass, render or brick can chip or mark the surface.

14.4 Sign-off and workmanship

On completion you or your representative inspect and sign off the work. Later claims are limited to defects that were not reasonably visible at sign-off. We will re-fix at no charge any item that comes loose within 30 days of installation because of our workmanship, provided the mounting surface was sound and the item has not been altered, struck or removed. This covers the fixing only; the item itself is covered by Section 15, and storm damage, vandalism and third-party actions are not covered.

15. Inspection, defects and remedies

  • Inspect your order as soon as you receive or collect it, and before you install or apply it. Report any problem within 7 days of delivery or collection, with your order number and clear photos of the whole item and of the problem. Transit damage must be reported within 48 hours under Section 13. We may ask you to return the item; if the defect is confirmed we bear the return cost.
  • A defect is an item that does not match the order (wrong material, finishing, or a size outside the tolerances in Section 9), a print or fabrication fault outside Sections 9 and 10, an item that arrives broken or delaminated (reported under Section 13), or a lit product that does not work on arrival.
  • Not a defect: anything within tolerance; anything in your Artwork; the difference between screen and print; damage after delivery, during your own installation or application, from weather, misuse, cleaning with solvents, vehicle washing or pressure washing; and normal wear.
  • Remedy: we choose between repairing the item, reprinting the affected pieces, or refunding the affected part of the order. We reprint first, and refund where a reprint is not reasonable. A replacement is sent to the original delivery address by the original method. We do not pay for installation, removal, travel, event or other consequential costs.
  • Claims made outside the time limits, or without photos, are not accepted.
  • Nothing in this section removes rights that the Consumer Protection Act 1999 gives you as a consumer.

16. Safety, regulatory and directional signs

Our ready-made safety, regulatory, warning, fire, workplace, property and directional signs follow common Malaysian formats and are supplied for your convenience. We do not warrant that any sign complies with a particular law, standard or code, including requirements of the Department of Occupational Safety and Health (JKKP), the Fire and Rescue Department (Bomba), the Uniform Building By-Laws, Malaysian Standards, the Public Works Department (JKR), or local council signage by-laws. Requirements change, vary by premises and are enforced by others. You are responsible for confirming that the sign, its wording, size, colour, pictogram, material and placement are correct and permitted for your premises and purpose, and for any installation requirement. Road and traffic signs are for private property only unless you are the authority responsible for the road.

17. Content we will not print

We may refuse, cancel or stop any order that we believe contains:

  • Content that infringes copyright, trademark, design or other rights, including brand logos, characters, artwork and photographs you are not licensed to reproduce, and counterfeit or look-alike branding.
  • Reproductions or imitations of currency, official documents, government, police, military, religious authority or other official emblems, seals, licences or signage.
  • Obscene, pornographic or sexually explicit material.
  • Material that is defamatory, harassing, or that invades someone's privacy, including images of people used commercially without their consent.
  • Material that promotes violence, hatred, discrimination, terrorism or illegal activity, or that contravenes Malaysian law, including the Sedition Act 1948, the Printing Presses and Publications Act 1984 and the Communications and Multimedia Act 1998.
  • Anything else we reasonably consider unlawful, unsafe or damaging to our reputation.

We are not obliged to explain a refusal. If we refuse an order before Production, we refund what you have paid. If unlawful content only comes to our attention after Production, no refund is due and Section 25 applies.

18. Intellectual property and portfolio use

  • Your Artwork stays yours. You grant us a non-exclusive licence to store, prepare, reproduce and print it to fulfil your order, to reprint it for you, and to keep it for our records.
  • You warrant that you own or are licensed to use everything in your Artwork, including logos, fonts, images, text and people's likenesses, and that printing it will not infringe anyone's rights or break any law. We do not check ownership, and we rely on this warranty.
  • Our work stays ours: our designs, templates, sign library, product photographs, layouts, website content, software and pricing. You may not copy or reuse them outside the product you ordered without our written permission.
  • Portfolio use: we may photograph and show finished products, work in progress and installations on our website, Google Business Profile, social media and marketing materials, without naming you personally. If you do not want your job shown, tell us in writing before delivery or installation, or at any later time, and we will not use it from then on.

19. Accounts, communications and automated assistance

  • You may order as a guest or with an account. Keep your password and your WhatsApp number secure. We act on instructions that come from your account, the phone number or the email address on the order, and we are not responsible for instructions given by someone who has access to them.
  • We send order updates by WhatsApp, email or SMS to the details you give us. These are part of fulfilling your order. Marketing messages are sent only with your consent, which you can withdraw at any time.
  • Some of our replies on WhatsApp, email and other channels are drafted with automated tools and reviewed by our team. They can contain errors. A price, discount, lead time, delivery date or specification is binding only when it appears in a Quotation, an order confirmation, or a written confirmation from our staff that refers to your order number.
  • Keep to one contact channel per order where possible. We are not responsible for a message you did not receive because a number was blocked, a mailbox was full, or a message was filtered as spam. If you have not heard from us when you expected to, check the order status on the website or contact us.

20. Promotions, promo codes, gift cards and member benefits

  • Promo codes and promotions are offered at our discretion, one code per order, cannot be combined unless stated, may exclude installation, delivery and certain products, and may be withdrawn or changed at any time. A code used in breach of its conditions, or obtained by abuse, may be cancelled and the order repriced or cancelled.
  • Quantity discounts are applied as shown at checkout and are calculated per order line.
  • Free delivery, where offered, applies to parcel-courier delivery only, above the threshold shown at checkout. It does not apply to Lalamove or oversized items, and does not waive the packing and protection charge. Member benefits may change or end at any time.
  • Gift cards are not refundable, cannot be exchanged for cash, and expire on the date stated on the card. Treat the code like cash: we are not responsible for a lost, stolen or shared code. If an order paid with a gift card is refunded, the gift-card portion is returned to the card.

21. Payment disputes, chargebacks and fraud

  • If you have a problem with an order, contact us first. We resolve genuine problems under Section 15.
  • A chargeback or payment dispute raised for an order that has been produced, delivered or collected, or that was cancelled in breach of Section 11, is a breach of these Terms. We may recover the disputed amount, gateway charges and our reasonable costs, refuse future orders, and refer the matter to the payment provider and the authorities.
  • For unusual orders we may ask you to verify your identity or your ownership of the payment method, and we may hold Production until we are satisfied.

22. Events beyond our control

We are not liable for any delay or failure caused by events outside our reasonable control, including flood, storm, haze, fire, epidemic or public-health restrictions, power or internet failure, machine breakdown, supplier or material shortage, courier disruption, strikes, government action, or failure of a payment, accounting, hosting or messaging platform we rely on. Time for performance is extended for as long as the event lasts. If it lasts more than 30 days, either of us may cancel the part of the order that has not entered Production, and we refund what you paid for that part.

23. What we promise and what we do not

We promise that your order will be made to the specification you ordered, within the tolerances in Section 9, with reasonable care and skill, and free from defects in materials and workmanship when delivered or collected.

We do not promise, and you should not rely on us for:

  • That a material or product is suitable for your particular purpose, location, surface or climate. You choose the material, and the descriptions on our website are general guidance.
  • A specific lifespan, colour match, or compliance with any law, standard, permit or building requirement.
  • That photographs, mock-ups, samples or previews show the exact colour, texture or finish of the delivered product.
  • That the website, pricing calculator or messaging channels will be available or error-free at all times.

Any product-specific warranty applies only where it is stated on the product page or in your Quotation. If you buy as a consumer, the guarantees implied by the Consumer Protection Act 1999 apply and nothing in these Terms excludes them. If you buy as a business, all other implied terms, conditions and warranties are excluded to the extent the law allows.

24. Limitation of liability

  • To the fullest extent permitted by Malaysian law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, contracts, goodwill or reputation, wasted expenditure, the cost of an event, opening, launch or campaign, the cost of installing, removing or replacing a defective item by anyone other than us, or charges from any third party, however arising and even if we were told of the possibility.
  • Our total liability for any order, whether in contract, tort (including negligence), under statute or otherwise, is limited to the amount you paid us for that order, or for the affected order line where the problem concerns one line only.
  • Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited or excluded under Malaysian law.

25. Your indemnity

You will indemnify and hold harmless UMAKE Design Group PLT, its partners, employees, contractors, installers and production partners against all claims, demands, losses, damages, penalties, costs and expenses, including legal fees, arising from your Artwork or the content of your order, any breach of the warranties in Section 18, any breach of law or of a third party's rights, your use or installation of the product, a missing permit or consent, or any breach of these Terms by you or anyone acting for you.

26. Conduct and reviews

  • We treat every customer with respect and expect the same towards our staff, drivers and installers. We may refuse, suspend or end service, and cancel unstarted orders with a refund, where there is abuse, threats, harassment or repeated unreasonable demands.
  • Honest reviews are welcome, including critical ones. Statements that are false, misleading or defamatory, or that publish our staff's personal details, are not. We reserve the right to respond publicly and to take legal action to protect our reputation.

27. Privacy

We handle your personal data under the Personal Data Protection Act 2010 and our Privacy Policy. To fulfil an order we share what is needed with our payment gateway, couriers and delivery drivers, our accounting and e-Invoice provider and LHDN's MyInvois system, our installers and production partners, and our messaging providers.

28. Governing law and disputes

These Terms and every order are governed by the laws of Malaysia. If you have a complaint, contact us first on WhatsApp or by email with your order number; most problems are settled within a few days. If we cannot settle it within 14 days of your first message, either of us may bring the matter before the courts of Malaysia, and you submit to their jurisdiction. If you are a consumer, you may instead bring an eligible claim before the Tribunal for Consumer Claims Malaysia, and nothing in these Terms limits any remedy the law gives you as a consumer.

29. General

  • These Terms, your order, our order confirmation and any Quotation form the entire agreement for that order and replace every earlier discussion or message about it.
  • If any part of these Terms is found invalid or unenforceable, the rest continues to apply.
  • If we do not enforce a term on one occasion, we may still enforce it later.
  • You may not transfer an order or any rights under it to anyone else without our written consent. We may subcontract production, delivery and installation, and may transfer our rights to a successor of our business.
  • Notices to you are validly given by email, WhatsApp or SMS to the details on your order. Notices to us go to the contact details in Section 30.
  • The English version of these Terms governs. Any translation is provided for convenience only.
  • The plain-words summary at the top of this page is a guide only. The numbered sections govern.
  • We may update these Terms. Each version carries its own version number and effective date, and the version in force when you place an order applies to that order. Material changes are announced on this page.
